Four men responsible for the
relentless bullying of a teenage waitress -
who later killed herself -
were today convicted and fined
a total of $115,000.

The company that runs Cafe Vamp
in Hawthorn, MAP Foundation,
was convicted and fined $220,000
after it and the four defendants pleaded guilty
in the Melbourne Magistrates Court
to failing to take reasonable care for
the health and safety of persons.

The charges were issued by WorkSafe Victoria.

Magistrate Peter Lauritsen
ordered cafe owner Marc Luis Da Cruz, 43,
manager Nicholas Smallwood, 26,
Rhys MacAlpine, 28, and
Gabriel Toomey, 23, and
MAP Foundation to pay a total of $335,000.

Mr Lauritsen, who described the atmosphere at the cafe
as almost ‘‘poisonous’’, said the bullying of Brodie Panlock, 19,
was ‘‘persistent and vicious’’.

He said the acts of the defendants carried
a high risk of serious injury and their culpability
was far too significant to warrant non-convictions.

Mr Lauritsen accepted their pleas of guilty exhibited remorse
and the penalties would be discounted because of them.

A coroner last year implicated MacAlpine and Da Cruz,
his company and two other former employees in
the physical and emotional bullying of Ms Panlock
at Cafe Vamp between 2005 and 2006.

Coroner Peter White found
she was treated in an
"extremely aggressive and intimidating" manner
at the Glenferrie Road business.

On the evidence of a former workmate, Mr White
described Smallwood and MacAlpine as
"relentless in their efforts to demean her".

Ms Panlock,
described at the inquest by a co-worker
as chirpy and compassionate,
killed herself in September 2006.

Aussies win 'Boxing Kangaroo' battle

A triumphant Australia has won its battle
with the International Olympic Committee
to display a controversial Boxing Kangaroo flag
at the Winter Olympics athletes village.

The image, which is draped over two storeys of the village and flanked by eight Australian national flags, shows a yellow kangaroo with red boxing gloves.

The IOC had ordered it to be taken down, claiming it was a registered trademark which violated Games rules.

But the issue was resolved following talks between IOC President Jacques Rogge and Australian Olympic Committee President John Coates.

"The IOC has a clean venue policy in order to protect the commercial rights of its sponsors," Coates said in a statement.

"But clearly on this occasion Australia was not trying to ambush either the IOC or VANOC (Vancouver organising committee).

"We are not selling authorised Boxing Kangaroo merchandise in Vancouver, nor is it available online.

"We will however need to register the Boxing Kangaroo going forward. The Boxing Kangaroo has been used as the Australian Team mascot since the Sydney Games," Coates added.

Australia's Deputy Prime Minister Julia Gillard on Saturday slammed the IOC's order as "ridiculous" and called for more flags bearing the famous symbol.

"It's a scandal," Gillard told Australia's Nine Network TV station.

"I think we want to see a lot of the Boxing Kangaroo, particularly now that we've had this ridiculous ruling. So, yes, boxing kangaroos everywhere."

The Boxing Kangaroo symbol came to prominence during the country's 1983 America's Cup yachting victory. The Australian Olympic Committee later bought the image from businessman Alan Bond, owner of winning yacht "Australia II".

Australian team chef de mission Ian Chesterman said it was a huge boost for the team ahead of the Olympics' opening on Friday.

"A big cheer went around our quarters when the word came through that the Boxing Kangaroo could stay," Chesterman said.

"Athletes from all around the world have been lining up to have their photo taken outside the Australian team headquarters, so popular has the flag become."

Insulation turns houses into
potential death traps

MANY homes are ticking time bombs
for their occupants who could die
putting just one step wrong.

Hundreds of homes that have been fitted with foil insulation
under the Rudd government's stimulus program
have been turned into potential death traps
because installers have laid the insulation over live wires
or used metal fasteners, causing it to become electrified.

An audit of almost 1,000 homes in Queensland has found that
in about two per cent of cases, foil insulation was installed
inappropriately, causing the roof to become "live",
The Australian reports.

This means that if home owners
enter their roof space
and touch the insulation,
they could be shocked or electrocuted.

If the foil touches metal frames or pipes,
it could cause other parts of houses,
including taps, to become electrified.

More than 37,000 homes have received foil insulation
under the government's program.

National Electrical and Communications Association
chief executive James Tinslay said the audit results
were frightening and
all remaining homes with foil insulation
needed to be inspected urgently by electricians
(and there's another Government/Brotherhood
CONTRACT/Pay Off)

Mr Tinslay said the government's decision to ban metal clips
was a Band-Aid solution.

The only way to avoid deaths was to
mandate inspections by electricians
before and after insulation was installed -
or failing that, to outlaw foil products.

Environment Minister Peter Garrett has committed to inspecting
10 per cent of those homes
but a spokesman said yesterday
this could be extended.

"The government will also urgently consider expert advice
based on the results of these inspections to determine
what further safety measures may be required,"
the spokesman said.

The inspection program, however, could be stalled
because the government has decided to end its current contract
and is yet to finalise arrangements with a new provider.

Mr Garrett's spokesman said

Sunny Barnes, 23,
whose 16-year-old brother Rueben
died while installing foil insulation in Stanwell,

said industry regulation was "laughable".

She said the scheme should be halted.

has been dogged by allegations of
rorting and malpractice
and has led to house fires.

IN MELBOURNE, the bells tolled half-muffled
before the solemn service in a grand cathedral.
In Kinglake, a crowd of 2000 watched
children release 173 butterflies,
one for every soul that had been lost.

But for every public ceremony yesterday, there were many private ones. In Bendigo, widow Carol Kane had her own humble way of commemorating the death of her husband Mick on Black Saturday: she planned to sit in their burned-out block with his favourite food, ''his packet of chips and his Coke, and just share''.

The first anniversary of the Black Saturday fires that killed 173 children, women and men and laid waste to swathes of rural Victoria was a moment to look back, mourn and reflect on a painful and historic year.

Premier John Brumby said he hoped it would mark the moment that looking back became looking forward: ''I actually think so many people, in a sense, are moving on after 12 months today. It's really important, it's like a line in the sand. I think for many people they're just keen to get to tomorrow and try to put the last year behind them and look more to the future.''

But his memories of that dreadful day, like the memories of so many Victorians who endured the flames and their aftermath, have not yet faded.

He recalled vividly, he said, ''the first morning in Wandong, just the devastation, the hills that were burned, the houses that were gone, the first discussion I had with the captain there, Frank Amoroso, whose first job that morning had been to locate deceased persons in homes that he'd known all his life … The number of people in the burns unit.

''And, I think, Marysville, just desolate. No birds, no sounds, no houses, no trees; just nothing, all gone. Those things will be in my mind forever.''

Just as the people who died will forever be in the hearts of those they left behind. Marysville resident Rod Liesfield lost his wife and two teenage sons. Yesterday he told a local church service, ''Losing someone you love is horrible. There's no way round it. You just have to go straight through the middle of the experience and pray that you come out the other side.

''Comforting platitudes are of little use at those times. Joy will come in the morning but first there is the night. In the last 12 months there has been a lot of night.''

Joan Davey, whose son Rob died at Kinglake with his wife Natasha and their two small daughters, Jorja and Alexis, read a tearful prayer in St Paul's Cathedral saying: ''As we remember those whom we have loved, we thank you for them, for all that they have meant to us. Help us to believe that none is forgotten by you.''

It was a day for thanking those who had provided earthly blessings, too. The torrent of generosity from other Australians that followed the fires was acknowledged by another mother at the service, Carol Matthews, who lost her son and her St Andrews home. She told the nation she and others had been sustained by the kindness of the public: ''On that day, we lost our past, our present and our future … Without your financial, practical and emotional support, we would not have survived.''

Anglican Archbishop Philip Freier said:

''We all learned something of that hidden capacity of empathy, and that was undoubtedly part of the incredibly generous response to the bushfire appeal … The best that we see at these times gives us a glimpse of a world that is healed and restored.''

In Kinglake, too, the urge to express gratitude was powerful and widely felt. More than a thousand people tried to crowd on to the ''thank you'' that had been chalked on the ground for other Australians.

The resilience of those bearing hardship was touched upon by Christine Nixon, head of the Bushfire Reconstruction and Recovery Authority, who told the cathedral congregation she had been amazed by what she had seen of human strength. She met one man who had been to 17 funerals, ''yet he spoke of being lucky: lucky to be alive, lucky to be involved in the building of the wonderful town he'd always loved''.

There were also nods to the fact that nature retains the power to overturn the best-laid plans of men and fire agencies. Mr Brumby said of the changes to fire policy: ''We're better prepared than ever before, but part of this will always rest with mother nature.''

Prime Minister Kevin Rudd agreed. He said the anniversary was an important moment to reflect on how, ''when disaster strikes, we come together as an Australian family. That's important. [It's] important secondly for the huge number of families affected, fundamentally.

''It's also important to us as a reminder
of how vulnerable we are to the catastrophes of nature.''

GOLD Coast police
took up to 3 1/2 hours to respond to
a violent domestic dispute in which a woman
was brutally bashed
in front of her nine-year-old son
and ended up on life support.

The boy told police his mother resembled "a rag doll"
after a sustained attack lasting up to 90 minutes.

It was so violent that her blood was found
splattered on the ceiling.

Police received a 000 call to a Burleigh Waters
unit but the officers were diverted to another disturbance.

By the time they arrived at the unit,
they found the woman unconscious in a pool of blood.

Last night she remained in intensive care.

Witnesses reported hearing the attack start about
12.30am on Saturday
but police did not arrive at the scene until 4am.

An internal investigation has been launched.

The police media office announced an
Ethical Standards investigation would be held
as the bashed woman's partner faced
Southport Magistrates Court yesterday
charged with grievous bodily harm.

Police prosecutor Myee Arandale told the court
the woman's son witnessed the "callous attack",
in which his mother was repeatedly punched and slapped.

"He described his mother as looking like a 'rag doll' while this
was occurring," Senior-Constable Arandale told the court.

"(Her) eyes were swollen black and
she was bleeding above one of the eyes.

"The defendant kept slapping his mother."

Sen-Constable Arandale said a "huge amount of blood"
was found at the scene.

Witnesses reported a commotion
lasting from 12.30am to 2am on Saturday,
the prosecutor said.

She said the accused man left his partner unconscious
to go upstairs for cigarettes.

Police found him asleep when they arrived.

Sen-Constable Arandale told the court the woman was
on life support in the Gold Coast Hospital with head injuries,
the extent of which would not be known until she was brought out of
an induced coma.

The court was told the accused had been banned
from going within 100m of his partner.

He had also twice been charged with assault
in recent months over unrelated matters.

The man initially applied for bail but withdrew his application
and said he would go to jail.

He will face a committal hearing in August.

A police spokesman said officers were responding to a 000 call
to the domestic dispute when they were flagged down
about another disturbance "requiring immediate police attendance".

"The South East (police) Region -
with the assistance of the
Ethical Standards Command -
will investigate the full circumstances
relating to the delay in responding
to the call for service," the spokesman said.

Insulation turns houses into potential death traps Article from: The Australian February 08, 2010 01:20am MANY homes are *ticking time bombs* for their occupants who could die putting just one step wrong. Hundreds of homes that have been fitted with foil insulation under the Rudd government's stimulus program have been turned into potential death traps because installers have laid the insulation over live wires or used metal fasteners, causing it to become electrified. An audit of almost 1,000 homes in Queensland has found that in about two per cent of cases, foil insulation was installed inappropriately, causing the roof to become "live", The Australian reports. This means that if home owners enter their roof space and touch the insulation, they could be shocked or electrocuted. If the foil touches metal frames or pipes, it could cause other parts of houses, including taps, to become electrified. More than 37,000 homes have received foil insulation under the government's program. National Electrical and Communications Association chief executive James Tinslay said the audit results were frightening and all remaining homes with foil insulation needed to be inspected urgently by electricians (and there's another Government/Brotherhood CONTRACT/Pay Off) Mr Tinslay said the government's decision to ban metal clips was a Band-Aid solution. *The only way to avoid deaths* was to mandate inspections by electricians before and after insulation was installed - or failing that, to outlaw foil products. Environment Minister Peter Garrett has *committed to inspecting* 10 per cent of those homes but a spokesman said yesterday *this could be extended.* "The government will also urgently consider expert advice based on the results of these inspections to determine what further safety measures may be required," the spokesman said. The inspection program, however, could be stalled because *the government has decided to end its current contract* and *is yet to finalise arrangements with a new provider.* Mr Garrett's spokesman said (lies, damn lies and STATISTICS, I mean, who's going to bother, getting their heads around this bit of 'NUMBERS JIGGLING') officials had analysed results from 400 of the 1,000 audits carried out so far, which showed five homes were live. She said the scheme should be halted. It's really important, it's like a line in the sand. I think for many people they're just keen to get to tomorrow and try to put the last year behind them and look more to the future.'' But his memories of that dreadful day, like the memories of so many Victorians who endured the flames and their aftermath, have not yet faded. He recalled vividly, he said, ''the first morning in Wandong, just the devastation, the hills that were burned, the houses that were gone, the first discussion I had with the captain there, Frank Amoroso, whose first job that morning had been to locate deceased persons in homes that he'd known all his life … The number of people in the burns unit. ''And, I think, Marysville, just desolate. No birds, no sounds, no houses, no trees; just nothing, all gone. Those things will be in my mind forever.'' Just as the people who died will forever be in the hearts of those they left behind. Marysville resident Rod Liesfield lost his wife and two teenage sons. Yesterday he told a local church service, ''Losing someone you love is horrible. There's no way round it. You just have to go straight through the middle of the experience and pray that you come out the other side. ''Comforting platitudes are of little use at those times. Anglican Archbishop Philip Freier said: ''We all learned something of that hidden capacity of empathy, and that was undoubtedly part of the incredibly generous response to the bushfire appeal … The best that we see at these times gives us a glimpse of a world that is healed and restored.'' In Kinglake, too, the urge to express gratitude was powerful and widely felt. The resilience of those bearing hardship was touched upon by Christine Nixon, head of the Bushfire Reconstruction and Recovery Authority, who told the cathedral congregation she had been amazed by what she had seen of human strength. She met one man who had been to 17 funerals, ''yet he spoke of being lucky: lucky to be alive, lucky to be involved in the building of the wonderful town he'd always loved''. There were also nods to the fact that nature retains the power to overturn the best-laid plans of men and fire agencies. Mr Brumby said of the changes to fire policy: ''We're better prepared than ever before, but part of this will always rest with mother nature.'' Prime Minister Kevin Rudd agreed. He said the anniversary was an important moment to reflect on how, ''when disaster strikes, we come together as an Australian family. **That's important.
