On March 21, 2011, my uncle Frank Dileo went into Cedars-Sinai to have open heart surgery. The surgery was successful, but in the early hours of 3/22/11 an incident occurred in which he bled out into his chest cavity, which led to a significant amount of time with no oxygen to his brain causing permanent brain damage. During this time my aunt was never notified about this complication until she arrived the next morning. My aunt was led to believe that my uncle was not waking up due to having twice the amount of anesthesia from having the second surgery. It was not until March 29 that we were finally told that his diagnosis was Hypoxic Ischemic Encephalopathy, which means minimal brain function and will remain in a vegetation state. For the past 2 years we have been trying to bring a malpractice case against Cedars-Sinai, but it has been dismissed today because all of the lawyers we have consulted were not given the complete medical records.

In my opinion, whatever anyone says we know that something happened that night which would not have happened if he was watched more clearly. It just kills me to know that one mistake caused my uncles life to be taken away from him..none of this should of happened

This is really interesting & Klein should have spoken up more about this fake, flawed & fraudulent will that the criminal Branca brought to court after Michael's death. I need to be fair that he has mentioned it before but he should have done so in a big way way sooner than this. He has also said that Miko Brando was there- but Miko works for the estate & is crooked also. Klein should also release the tapes he says he has of Jackson leaving his office. Corrupt Officials Exposed: $30M Embezzlement Cover-up Surrounding the Death of Michael Jackson.

Silenced: Michael Jackson’s plastic surgeon Dr. Arnold Klein speaks out against a bank fraud scandal involving California State Officials & The Private Bank of California with new evidence.

Dr. Arnold Klein filed for bankruptcy on January 20, 2011 after obtaining legal counsel from his attorney David Neale regarding how to re-claim the nearly $30 million that Klein was embezzled from him by his employees Muhammad Khilji, Jason Pfeiffer with the help of Robert Lorsch through the Private Bank of California. Neale is said to have assured Klein that these adversarial cases would be heard in the courts and encouraged him to take action.

To Klein’s dismay the cases were not heard, and have not been in almost 3 years. For bankruptcy claims such as these, the system is legally obligated to provide “due process of (Federal) law.”

“I am very much aware of the events surrounding Mr Jackson’s death,” says Klein, “and (I) believe the fraudulent manner in which my bankruptcy has been handled is based both on the bank fraud committed by Private Bank and an attempt to prevent me from disclosing information that I have concerning the death of Michael Jackson.”

Shortly after Klein filed for bankruptcy, it was revealed that the case’s Judge, Richard Neiter, held stock in the Private Bank of California. Klein states that, long before Neiter’s conflict of interest was discovered, he had already bifurcated the cases such that to this day they have not been heard. In addition to this, Klein’s allegations describe Judge Neiter’s selection of Bradley Sharp as Klein’s trustee to be based on a “totally fraudulent loan” through the very same bank.

“The manner in which the lawyers, trustees and Judges of this court of law are closely aligned with this same fraudulent financial institution brings the entire legal system into question,” says Klein. “For a Federal Court to be compromised in this manner… is far more than a simple embarrassment: it is criminal.”

Since the time of Bradley Sharp’s appointment as Klein’s trustee it has come to light that Sharp has also been involved in questionable activity with the Private Bank of California and ALSO HAS A CLOSE RELATION WITH THE CHIEF EMBEZZLER MUHAMMAD KHILJI APPEALIG HIS RIGHT TO TESTIFY.In a recent interview, Klein as well as the Jackson family call into question the authenticity of Michael Jackson’s last will and testimate stating their belief that it is a forgery. Klein insists he was with Jackson in New York on July 7th 2002, the same day that the Will was supposedly signed by Jackson in L.A. The executor of the will that was “signed” in L.A. was none other than John Branca, who is also coincidentally a member of Private Bank, holding two seats on the board.

Klein suspects his cases for embezzlement were intentionally silenced to avoid bringing any un-favourable attention to the Private Bank of California or a further investigation of the details surrounding the Will of Michael Jackson, it’s executor, and beneficiaries.

Klein is now going public with his knowledge about Harvey Levin, John Branca and Howard Weitzman who were working with the allegedly fraudulent Will of Michael Jackson when they were awarded $700M a year while Klein, a close friend of Jackson and the Jackson family was left “penniless with (his) bill for rebuilding Michael’s face never paid.” (Klein)

Up to this point the breaking news concerning Klein and the case of Jackson’s death has revolved around his declaring bankruptcy and the details surrounding the fall from a luxurious lifestyle. Completely neglected are the facts leading up to his bankruptcy, his reason for filing and the corruption of powerful members of a privately held institution: The Private Bank of California.

Details of the Embezzlement

Klein hired Muhammad Khilji in 2007 and records show that Khilji began to embezzle almost immediately.

In August 2009 Khilji, Jason Pfeiffer and Robert Lorsch with the assistance of Todd Neilson (CEO of The Private Bank of California) opened several bank accounts at the bank. Klein was never informed of those accounts.

Klein did not enter the Private Bank of California or meet with any of the bank’s representatives. Neither the signature cards nor the power of attorney documents are signed by Klein.

Khilji and Pfeiffer had Private Bank send account statements and other documents to Bob Lorsch’s accountant instead of Klein’s office. This misdirection of account statements prevented Klein from discovering the fraudulent activity until it was too late.

It is evident that two of the accounts bear the name “Khilji-Pfeiffer.” Khilji-Pfeiffer, LLC was used to illegally funnel millions of dollars from Klein to Muhammad Khilji, Jason Pfeiffer and Robert Lorsch at mymedicalrecords.com. Klein’s allegations indicate that these men made illegal mortgages on his homes, setup fraudulent credit lines and embezzled his entire retirement fund through these accounts.

Dr. Arnold Klein Graduated University of Pennsylvania, School of Medicine and did his post-graduate education at Cedars-Sinai Medical Center. His medical residencies in dermatology were at the Hospital of the University of Pennsylvania and the University of California at Los Angeles (UCLA). He had a major role in the development of famous injection techniques for Botox, collagen, Restylane and Juvederm.

Michael Jackson, Elizabeth Taylor, and many others were on his A-List client list throughout his illustrious career.



Klein has made a 25-year commitment to treating and finding a cure for AIDS. In 1984, he and others founded the American Foundation for AIDS Research, where he continues to serve as Founding Member and Director. Additionally, Dr. Klein is a founder of the Rose-Tarlow-Arnold W. Klein Breast Cancer Foundation at UCLA, which provides breast cancer treatment for individuals who are unable to afford such treatment. Most recently, he established the endowment for the Elizabeth Taylor Center for AIDS Research. He also serves as a Trustee to the Jennifer Jones-Simon Foundation, the UCLA Center for the Health Sciences and The Hereditary Disease Foundation, which works to raise funds and awareness for inherited diseases.

NEW YORK — A nurse who cared for the late tobacco heiress and philanthropist Doris Duke charged in court papers made public Friday that she “did not die of natural causes” in her Beverly Hills mansion in 1993, but instead succumbed to a “massive sedation regime” instigated by her butler.”Miss Duke did not ask that a lethal dose of morphine be given to her and she was not aware this was being done,” Tammy Payette, the nurse, charged in an affidavit submitted to the court handling the probate of Duke’s $1.2-billion estate. Payette was a principal nurse aiding the 80-year-old heiress in the weeks before she died on Oct. 28, 1993.



On Friday, the judge handling the probate here appointed Richard Kuh, a former Manhattan district attorney, as limited temporary administrator of the estate with power to look into the allegations. She ordered him to report back within 45 days. California law enforcement authorities said Friday that they had not yet been apprised of the contents of Payette’s affidavit.



Payette said that despite being on the mend after suffering a stroke, Duke was given increasingly large doses of sedatives by a physician at the request of Bernard Lafferty, Duke’s butler and adviser. The cause of death was listed in 1993 as progressive pulmonary edema.



Under the terms of Duke’s final will, Lafferty is to inherit a lump sum of $5 million, will receive a lifetime annuity of $500,000 a year, and was named co-executor of the Duke estate along with the United States Trust Co. of New York.

In a statement issued by Chen Sam, his public relations counsel, Lafferty labeled the charges “crank allegations” and “McCarthy-esque smear tactics.” “These scandalous allegations are an offense to a friend to whom I was devoted in life and whose wishes I am working hard to carry out after her death. The facts of her death speak for themselves, and her doctor has testified at length about that.” the statement said.



The lawyer representing Dr. Charles F. Kivowitz, the primary attending physician who cared for the heiress during the last days of her life, said Kivowitz “totally denies these outrageous accusations and plans to pursue whatever legal remedies are available to him against those who submitted the affidavit and wrote it.”"His reputation and character are impeccable,” said Los Angeles attorney Leonard Levine. A number of claims have been filed against the estate under the probate proceeding in Judge Eve Preminger’s court in Manhattan. Among them are filings by three former Duke servants and by Dr. Harry B. Demopoulos, a former Duke physician.



A lawyer for the three servants said he discovered Payette in the course of his investigation. Demopoulos was a longtime Duke friend and was named in a 1991 will as an executor and trustee of her estate. He is challenging the appointment of both Lafferty and the bank as co-executors under the later will. Demopoulos, an associate professor of pathology at the New York University School of Medicine, charged in recently filed court papers that nurses’ notes specifically quote the heiress’s fear of being “murdered.”“On Sept. 20, 1993, just hours after she returned home from a hospitalization, Miss Duke informed her nurses that someone was trying to kill her,” the papers allege. “The nurse’s notes state: ‘Patient distress–states she’s afraid of being murdered.”



Demopoulos said that nurses’ notes on Oct. 7 show that Duke wanted to be moved to Cedars-Sinai Medical Center or to Duke University Medical Center, which her father had founded. Demopoulos leveled a barrage of charges against Lafferty in the filings, including allegations that he is a chronic alcoholic who has been hospitalized several times for treatment under false names, is a drug abuser, and “is a violent abusive individual who threatens physical violence to cover up his own misconduct.” Demopoulos alleged that while the butler’s employer lay dying, Lafferty was on Rodeo Drive “engaging in grossly extravagant shopping sprees” and that “since Miss Duke’s death, Lafferty has acted as if he were Miss Duke.”

He also charged that the tobacco heiress was “subjected to heavy sedation” which was manipulated to serve the butler’s ends, including procuring the later will.



In a statement, Lafferty labeled Demopoulos’ accusations “obstructionist.” He said under the prior will, Demopoulos would have stood to collect approximately $25 million in fees for acting as executor, five times the amount authorized for Lafferty in the final will. Duke’s former butler said he and the bank are “confident” the court will agree that Demopoulos lacks standing to bring his suit.

A wrongful death lawsuit filed by MICHAEL JACKSON's mom Katherine Jackson is heading to trial.

In 2010, the King of Pop's mom filed a civil lawsuit against AEG Live, the concert giants behind the star's doomed comeback shows in London, claiming bosses were negligent in ignoring life-threatening health concerns going on behind closed doors at his rented Los Angeles mansion.

On Thursday (28Feb13), Superior Court Judge Yvette Palazuelos dismissed all but one count in the lawsuit against AEG Live executives, who were responsible for hiring Conrad Murray - the doctor who was convicted of involuntary manslaughter in the Thriller star's death.

Katherine will now go to trial on 2 April (13) over allegations AEG Live heads negligently hired and supervised Murray.

Marvin Putnam, an attorney for AEG, has argued that Murray was not employed by the promoter and insists he is confident the company will win in court.

Jackson died in June, 2009 while preparing for his doomed series of gigs in the British capital.

Los Angeles (CNN) -- A "smoking gun" e-mail allegedly connecting a concert promoter to Michael Jackson's death was revealed this week as a judge unsealed documents in the wrongful death lawsuit filed by Jackson's mother and children.

The trial next month in Los Angeles could shed new light on the pop icon's last days as Dr. Conrad Murray, who did not testify at his own involuntary manslaughter trial, and Jackson's oldest son Prince, 16, are on the witness list.

Jackson died two weeks before his "This Is It" comeback concerts, organized by AEG Live, were to have debuted in London in the summer of 2009. E-mails suggested that the promoter was worried about Jackson's missed rehearsals and they sought Murray's help in getting him ready.

Prince, Paris and Blanket Jackson and their grandmother, Katherine Jackson, contend that AEG Live's pressure on Murray to have Michael Jackson ready for daily rehearsals despite his fragile health led to his death from an overdose of surgical anesthetic.

The judge ruled Wednesday that Jackson lawyers have shown enough evidence that AEG Live hired and supervised Murray to warrant a jury trial. She also ruled there was evidence to support the Jacksons' claim that AEG Live executives could have foreseen that Murray would use dangerous drugs in treating the pop icon.

"Now that the court has ruled that there is evidence that it was foreseeable that AEG's actions resulted in Michael Jackson's death, the Jackson family feels vindicated from the public smear campaign that AEG has waged against them," Jackson lawyer Kevin Boyle said Sunday. "The truth about what happened to Michael, which AEG has tried to keep hidden from the public since the day Michael died, is finally emerging. We look forward to the trial where the rest of the story will come to light."

A cornerstone of the Jacksons' case is an e-mail AEG Live Co-CEO Paul Gongaware wrote 11 days before Jackson's June 25, 2009, death. The e-mail to show director Kenny Ortega addressed concerns that Murray had kept Jackson from a rehearsal the day before: "We want to remind (Murray) that it is AEG, not MJ, who is paying his salary. We want to remind him what is expected of him."

Jackson lawyers, calling it a "smoking gun," argue the e-mail is evidence that AEG Live used Murray's fear of losing his $150,000-a-month job as Jackson's personal physician to pressure him to have Jackson ready for rehearsals despite his fragile health.

Ortega, who had worked closely with Jackson on previous tours, sounded a loud warning about his health after Jackson showed up for a rehearsal shivering just over a week before his death. He wrote in an e-mail to AEG Live President Randy Phillips: "It is like there are two people there. One (deep inside) trying to hold on to what he was and still can be and not wanting us to quit him, the other in this weakened and troubled state. I believe we need professional guidance in this matter."

Phillips responded with a glowing endorsement of Murray: "This doctor is extremely successful (we check everyone out) and does not need this gig so he is totally unbiased and ethical."

Jackson lawyers point to another e-mail exchange as evidence that Phillips was directly involved with pressuring Murray to have Jackson at rehearsals. The e-mail was sent by AEG Live tour accountant Timm Woolley to an insurance broker two days before Jackson died: "Randy Phillips and Dr. Murray are responsible for MJ rehearsal and attendance schedule."

Murray told investigators two days after Jackson's death that he used the surgical anesthetic propofol every night for two months to help him rest for rehearsals. It was a procedure Jackson demanded, he said. The Los Angeles County coroner ruled that Jackson had died from an overdose of propofol in combination with sedatives. Murray is serving a prison sentence for his involuntary manslaughter conviction.

AEG Live argues it has no liability in Jackson's death because Murray was not its employee. AEG lawyer Marvin Putnam did not respond Sunday to CNN calls for comment, but he did give a short statement last year: "Defendants did not hire Dr. Murray nor were they responsible for the death of Michael Jackson."

The lawsuit seeks a judgment against AEG Live equal to the money Jackson would have earned over the course of his remaining lifetime if he had not died in 2009. If AEG Live is found liable, it could cost the company several billion dollars, according to estimates of Jackson's income potential. AEG Live is a subsidiary of AEG, a global entertainment company that is now for sale with an $8 billion asking price.

Los Angeles County Superior Court Judge Yvette Palazuelos, in her ruling rejecting AEG Live's request to have the case thrown out, said she agreed that the Jackson lawyers provided evidence that AEG Live didn't do "a sufficient background check of Dr. Murray, which would have established that Murray was deeply in debt."

Jackson's previous relationship with Murray, who treated him and his children for minor illnesses in Las Vegas, did not relieve AEG Live of liability, "although the fact may be relevant in determining proportional liability and damages," she said.

While the AEG Live lawyers argued the company could not have foreseen that Murray might use dangerous drugs on Jackson in preparation for the tour, Palazuelos said there was evidence that Gongaware had "previous tour experiences" with Jackson in which "tour doctors" gave "large amounts of drugs/controlled substances to him." Gongaware testified in Murray's trial that he worked as tour manager for Jackson's "Dangerous" and "History" tours before joining AEG Live.

The judge cited "Gongaware's general knowledge of the ethical issues surrounding 'tour doctors' and the practice of administering drugs to performing artists."

"There is a triable issue of fact as to whether it was foreseeable that such a physician under strong financial pressure may compromise his Hippocratic Oath and do what was known by AEG Live's executives to be an unfortunate practice in the entertainment industry for financial gain," the judge wrote.

Scopitone films were a forerunner of music videos and the ItalianCinebox/Colorama and Color-Sonics were competing but lesser-known technologies of the time.Based on Soundies technology developed during WWII, color 16 mm film clips with a magnetic soundtrack were designed to be shown in a specially designed jukebox.The $2 million profit from this business deal made Malnik a young millionaire and introduced him to the entertainment world. From this venture, Malnik developed long-lasting business and personal relationships with several “Rat Pack” celebrities including Frank Sinatra and Dean Martin. Malnik and his friend, the late Jay Weiss, purchased and remodeled The Forge restaurant in Miami Beach in 1968.

Michael Jackson loved the the Scopitone. In January/February 2003 Michael drew up another will in Florida. In this document the executors were Al Malnik, ( a bit shady to many) as his new advisor and John McClaine a long time business associate and friend. In addition a new lawyer of Michaels named David LaGrand, and Michaels new accountant Allan Whitman were named the head of Michael Jackson’s foundation. The foundation was suppose to have kept the Ranch running for his children to live in and kept the ranch perserved In Its current state forever. Al Malnik was to become the guardian of blanket and Michael became the guardian of one of Al Malniks young children. The remaining two children would be raised by Michael’s close personal/family friends in New Jersey who he stayed with after 9/11. Marc Schaffel who worked with Michael and was one of Michaels closest confidents at that time told me he has supporting documents on this second Will which Michael told me about. This is not Michael’s final will.

Three Agreements between Michael Jackson and Tohme


Finder's Agreement

1. In early 2008, Jackson started looking for someone to refinance the loan on Neverland Ranch. While acting as a consultant for Colony Capital AND as Jackson's business advisor, Tohme and Jackson entered an agreement in which Tohme would receive a 10% finder's fee for locating a company to refinance Neverland. In addition, the agreement stated that Jackson would pay 10% of the gross proceeds to Tohme if Jackson sold any interest in Neverland. Lastly, the agreement stated that Tohme would receive 10% of any future profit through any transaction brought to Michael by Colony Capital. The Estate's claim states "the services Tohme performed for this excessive compensation were simply to introduce Jackson to Colony."


The Estate also claims that "the final terms imposed on Jackson contained newly created restraints in connection with Jackson's use and control of the Ranch, along with financial terms disproportionately favorable to Colony and inferior to those Jackson would have been able to obtain had he been represented in negotiations at the outside by an independent advisor without any financial interest in the transaction." The Estate claims that by being a consultant to Colony Capital, while simultaneously representing Jackson as a business advisor AND in agreement with Jackson for a finder's fee, this is a conflict of interest, and therefore should be found legally void. The Estate also claims that there were other options that were open to Jackson regarding the refinancing of Neverland, yet Tohme utilized his connections with Colony Capital to gain his finder's fee.



2. Services Agreement

Jackson and Tohme entered into a Services Agreement on July 2, 2008. The terms of the services agreement stated that Tohme was guaranteed to be paid $35,000 a month, plus expenses regardless of whether Michael made money or not. In addition, Tohme would receive "15% of all gross compensation received by (Jackson) including live performances, merchandising, electronic arts, recorded and live telecasts, motion pictures and animated projects." The Estate claims this agreement far exceeds the normal and customary fees charged by a business advisor.

3. Indemnity Agreement

The Estate also claims that Michael signed 2 power of attorney documents to Tohme in August 2008, which were, like the finder's agreement and the services agreement, disporportitionately favorable to Tohme and inferior to Jackson. The Estate also claims that Tohme had Jackson sign an indemnity agreement on August 6,2008, which gave Tohme broad indemnities which were beyond customary.

The Estate gives the example of Tohme giving Michael's artwork to Brett Livingstone Strong as an example. "Tohme asserts that he had the power to make the gifts pursuant to the Power of Attorney that were allegedly executed by Jackson." The Estate claims Tohme has no Power of Attorney to give gifts of Michael's property to third parties, and that the Estate owns all of Jackson's property, not Tohme.

Other Claims

1. The Estate claims that within the AEG agreement for the This Is It (TII) tour and concerts, Tohme is given, on top of the services agreement fee, $100,000 a month. This fee is advanced to Tohme by AEG, but would have been recouped by Jackson had he lived.

2. The Estate claims that Tohme is still in possession of Jackson's money and property. The estate claims not only does Tohme have some of Jackson's money ("in the millions"), but that Tohme comingled Jackson's money with his own. The Estate also claims that Tohme is still in possession of Jackson's property; and that he may have disposed of some of the property (like Michael's artwork) without having the authority to do so.

So if we look at Tohme's compensation agreements prior to Michael's death, here's what we have:

Finder's Fee: 10% profit of the sale of Neverland
10% of gross proceeds if MJ ever sold any interest in Neverland
10% of any profit MJ earned through Colony Capital
Services Fee: $35,000 per month
All expenses paid
15% compensation for any work done by MJ
Power of Attorney: Power to do what he pleased with regard to Michael's work
or property
AEG Agreement: $100,000 per month

This is, like the Estate has claimed, extraordinarly outrageous and not the customary fee. The Estate claims that because there was no independent counsel involved in any of these agreements, that they should be declared null and void, and that Tohme should in some instances, pay back double what the Estate has lost.
