lol Mike. Are you on the same forum as everyone else!?
There's no summons because the PCN's not a bill and are claiming money unlawfully.
Plus it would go to sherrifs office or something for collection but you tell them you asked for a bill and the council failed to provide so the matters closed. Enclose a copy of your notices and they shut tf up

@OP

what they sent you there is basically a standard letter to get you fall back in the trap. They stated they didn't accept the representation and the ticket was issued correctly. I get theses letters alot from the local parking office after I send a notice asking for a bill in accordance with bills of exchange act 1882.

I reply with something along the lines of:

1. I never made representation - I conditonally accept any lawful obligation and ask for a bill
2. I never contested the ticket was issued incorrectly - give me my bill!!!

then I set a time limit for response.
and it never arrives.

no not for me as ive offered to pay it in full with honours, ive consistantly asked for a bill and contract. which they have failed to provide, so hence nelc are in dishonour!!!

WOW! thanks for your posts, was beginning to fear the worst after this had sat on the forum with no posts for a good while. BUT, i will stick to the proverbial guns, and compose a suitable letter stating that i shall pay the fine if they provide a bill, but also that they are mistakenly sending letters wrongly addressed to an entity known as... my assigned moniker.

p.s. [mole] very crafty, very crafty indeed!

THANKS for your amazing assistance... i have composed the following letter, which is probably clumsily written but 1.5hrs sleep (etc. etc. excuses excuses) and barely a rudimentary grasp of the ins and outs of being a freeman of the land limit my capabilities!

Dear Parking Services,

Thank you kindly for your recent letter, dated 28OCT09, which I received on the 30OCT09.

Further to your letter, I am categorically stating that:

1. I never made representation - I conditionally accept any lawful obligation and ask for a bill.
2. I never contested the ticket was issued incorrectly and am requesting the bill in accordance with bills of exchange act 1882.

Please note that I am graciously and humbly asking for you, Sheffield City Council, to send a bill to above named so that I can administer my accounts, I will also need to see a contract that binds me to that bill as is the legal right of above named.

I sincerely look forward to the closure of this matter with great amicable speed and urgency, as I am sure Parking Services wish so too.

thankyou for your notice' i accept your notice , noticeing you with this notice.

as a notice is not a bill but mearly an announcment as defined in law, am i supposed to pay a notice?



you have made demands from me which i dont understand and in order to stay within the law and to maintain my god given rights i need clarification. If a stranger came to you in the street and demanded you pay him money would you pay or ask why?

so as i conditionally accpet your demand but i need for you to provide me a bill and the contract which made me liable for the bill.

this is within the legislation enacted in 1882 called the bills of exchange act.

let me stress that im more than willing to pay the ammount outstanding but to settle my account i need the information required.

i thankyou for reading my notice

Why is it that everyone on here makes the fundamental mistake of believing that an invoice is a bill of exchange? The two are completely different. Does nobody do any research?

Hi waterpistol, I read your thread last night and this morning I recieved exactly the same letter as you. I have previously sent them a request for clarification letter. I didnt realise your thread would have been so relvant lol.
Anyway, Im going to use the the template that Bones has kindly added here and let them deal with that! Thanks Bones

i said notice, bill of exchange and contract.

Ok, if you would prefer: A PCN is not a bill of exchange, a notice demanding payment of a PCN is not a bill of exchange, an Order for Recovery issued by TEC regarding a PCN is not a bill of exchange........ however when you write out a cheque to whoever, even yourself.... that is a bill of exchange
