View Full Version : Red light camera FLASHED, considering how to deal

I got flashed by a red light camera today. I believe the light was yellow/amber, but the light still flashed.

I expect to receive a letter in the next few weeks asking who was the "driver".

I am expecting to challenge the authority, the statute/law, and perhaps the process.

I am willing for it to go to court if it cannot be dealt with outside, but I am fully aware of many of the things/tricks that are going on without most of us knowing, and I'm prepared to stand up for myself.

Any suggestions, advice, or constructive criticism is welcome.

ask them to prove that someone operating your automobile/car was 'driving' (acting in commerce). it be interesting to see what their response is.

I expect to receive a letter in the next few weeks asking who was the "driver".Possibly. If it's one of the new digital ones ones then most likely. If it's one of the older ones then the chances are they won't have a pic. Over 50% of them don't have film in and of those that do 80% are full.

I am expecting to challenge the authority, the statute/law, and perhaps the process.Just ask to see the maintainers calibration certificate for the device in question and also the police calibration certificate. Unless you are very unlucky they won't match. Case closed.

I was guilty as hell on the first (41 in a 30 limit). Truth is even if it were yellow as you went through unless you can show it was dangerous to attempt to stop you are banged to rights. And that doesn't mean "I didn't have time to stop" because that = "I was going too fast". There is nothing to stand up for I'm afraid. Have a good mitigation story available and be humble.

Hi, ive been told by a friend of a friend's Solicitor that once you open your letter and log on to the website where you are able to see your red light and or speeding picture, then the authorities responsible have proof that you have acknowledged that the offence took place, so the advice i was given, was that unless your letter is delivered by recorded post, never ever log on to the relevant site in the letter, do not get in contact with the Police...wait until they contact you, they cant prove you ever recieved the letter in the first place if it was sent via normal post.
This friend in question recieved a £100+ fine, no points and for an offence of speeding at over 100 mph which normally carries an automatic ban.

I would like to clarify that this was a setting off from the traffic lights at speed, and that it was possibly capturing the automobile to my left instead.

I expect to receive a Notice of Intended Prosecution, or more likely a Conditional Offer of Fixed Penalty... Would it be possible just for these Notices to be discharged/cancelled by either:

1) Writing out a Notice of Discharge
2) Writing a Conditional Acceptance of the Conditional Offer

... Why would anyone send out a Conditional Offer for?, and What does it mean to receive one?

Also, since a offer is not a Notice, must it be replied?

Can't help you on the freeman angle as I still haven't looked into it properly yet.

However, the guys at Pepipoo are very good on fighting motoring-related cases. It's up to you. Good luck, however you choose to tackle it. :)

Conditionally accept on proof of claim. Meaning I'll accept it as long as the plaintiff can prove it in court. The plaintiff is the speed camera of course. lol

OR

If THEY say, it's the MET or government police force. Then thats OK. Ask for IT not a representative to testify in court. Cant, there is no such thing, it's a corporation and a corporation is DEAD.

They must provide you a Remedy and due process of law.


OR

Easy way out. No arguements, but it will cost you less. Is, state that you are not the name on the license but a freeman and plead guilty to the FACT not the charge. They'll whack you with a court cost, not a fine. Be honourable at all times, don't argue and don't be silent.

A sneeze is an 'act of God' which disrupts your attention for a few seconds, long enough for you to have missed the light change. I am NOT suggesting that you lie or anything ;) cuz that would be wrong.
