Lemonade Raids? Farm Stands and Local Power

'In New Hampshire, who should regulate children’s lemonade stands? The correct answer is: No one. But common sense does not always prevail, at the local or state level.

Legislators will consider a bill next year that would return to the state the power to regulate farm stands. The Department of Health and Human Services wants the authority because farm stands now sell milk, cheese, jams and other perishable items that could get contaminated if improperly processed or kept at the wrong temperature.

At a House Commerce and Consumer Affairs subcommittee meeting this week, Rep. Donna Mauro, R-Windham, asked the representative from HHS if any of these items sold at a New Hampshire farm stand have ever made people sick. The answer: Not to the HHS representative’s knowledge, New Hampshire Business Review reported.'
